    Het is natuurlijk vreemd, zon enorme gevangenis middenin een dichtbevolkte Rotterdamse woonwijk. In 1872 ging de gevangenis open. Het gebouw bood plaats aan zon 450 gedetineerden en evenzovele werknemers. Tot aan 1953 deed het gebouw met zijn markante cellenvleugels dienst als gevangenis. Daarna was De Noordsingel zoals het complex in de volksmond wordt genoemd, alleen nog in gebruik als Huis van Bewaring. 140 jaar na de opening sloten in 2012 de deuren van De Noordsingel definitief.Over De Noordsingel zijn vanzelfsprekend enorm veel verhalen te vertellen. Lida Hoebeke en Conny Rijken gingen op onderzoek. Ze spraken veel mensen die er gelogeerd en gewerkt hebben. Maar ook buurtbewoners en mensen die op de een of andere manier iets met De Noordsingel te maken hadden. Een selectie van deze verhalen is opgenomen in dit boek.

    Ondanks pogingen van de Nederlandse overheid om niet-rechtmatig verblijf tegen te gaan en te ontmoedigen zijn er mensen die zonder verblijfsvergunning in Nederland leven. Over de manier waarop zij (over)leven en werken in Nederland is echter weinig bekend. Hoewel hun verblijf niet-rechtmatig is, betekent dit niet dat migranten zonder verblijfsvergunning geen rechten hebben. Integendeel. Dit boek verbindt de juridische wet- en regelgeving op nationaal en internationaal niveau met de sociaaleconomische werkelijkheid van deze kwetsbare groep migranten. Op basis van uniek empirisch materiaal toont deze studie de discrepantie tussen de rechten die ook voor migranten zonder verblijfsvergunning gelden, bijvoorbeeld als werknemers, als patiënten of als inwoners, en toont het de afwezigheid van bescherming in de dagelijkse praktijk.     Ryszard Piotrowicz is Professor of Law at Aberystwyth University. He was a member of the European Commission’s Group of Experts (2008-15) and has been a member of GRETA, the Council of Europe’s Group of Experts on Action against Trafficking in Human Beings, since 2013. He has published extensively in the field of migration law, especially with regard to refugees and trafficking in human beings. Prof. Piotrowicz is the Book Reviews Editor of the International Journal of Refugee Law. He has lectured and spoken at conferences on human trafficking across the world. Most recently he has worked on the issue of non-punishment of victims of trafficking (for OSCE) and on trafficking for forced begging. Conny Rijken is Professor of Human Trafficking and Globalisation at INTERVICT, Tilburg Law School, Tilburg University. Prof. Rijken has done extensive research on various aspects of trafficking in human beings including the European perspective, migration, labour exploitation and human rights. She has been leading several (EU funded) international and interdisciplinary research projects, e.g. ‘Combating THB for Labour Exploitation’, ‘Corporate Social Responsibility to Prevent Human Trafficking’ and one on Joint Investigation Teams. Central in her research is the focus on human rights and engagement with the position of the individual. Baerbel Heide Uhl is a political scientist and has been working on anti-trafficking politics both in academia and in operational missions in Europe for more than two decades. She is a co-founder of the European NGO network ‘La Strada’ and a founder of the NGO initiative datACT, data protection in anti-trafficking action. Dr.Uhl held positions of anti-trafficking expert for the OSCE Mission to the Federal Republic of Yugoslavia and the OSCE Office for Democratic Institutions and Human Rights (ODIHR). In addition, she advised EU candidate countries and new Member States, including Turkey, Croatia, Bulgaria and Romania, on European anti-trafficking policies within the framework of EU enlargement procedures. Dr.Uhl was a member of the European Commission’s Experts Group to Combat Trafficking in Human Beings from 2003-2007 and served as the Chairperson to the second Group from 2008-2011. She is a Member of the Advisory Board of La Strada International. She earned her PhD and her Diploma in Political Science at the Free University of Berlin.

    This publication presents the results of a two-year research project that aimed to develop and pilot a methodology for exploring the nexus between statelessness and human trafficking. It was a collaborative project in which scholars with expertise on statelessness (Laura van Waas), human trafficking (Conny Rijken), Subjective Legal Empowerment (Martin Gramatikov) and gender studies (Deirdre Brennan) worked side-by-side to design and execute research that cuts across disciplines. We hope that the publication will therefore be of interest to researchers and policy makers in each of these different fields. Included within this publication are two distinct but complementary reports: "A methodology for exploring the interaction between statelessness and human trafficking" (or Methodology Report) and the "The Nexus between Statelessness and Human Trafficking in Thailand" (or Thailand Report).

    een verkennende studie naar behoeften en belangen van slachtoffers mensenhandel in Nederland

    De huidige aanpak van mensenhandel in Nederland spoort niet met het verwerkingsproces van slachtoffers die net zijn ontsnapt aan hun uitbuiters. Onderwerpen die pas later aan de orde zouden moeten komen, zoals medewerking aan een proces tegen de daders of illegaal verblijf in Nederland, worden nu onmiddellijk en op een verplichtende manier aan de orde gesteld door politie en justitie. Maarveel slachtoffers van mensenhandel wantrouwen politie en justitie juist, zijn getraumatiseerd of worden bedreigd met represailles, wat hen belemmert hun (hele) verhaal vertellen. De vaststelling of iemand slachtoffer is, zou dan ook niet door de politie moeten gebeuren, maar door teams van deskundige hulpverleners, tolken en rechercheurs die in eerste instantie gericht zijn op crisisopvang en hulpverlening, aldus de onderzoekers. Wanneer medewerking met de politie berust op een in vrijheid gemaakte keuze, zullen slachtoffers naar verwachting meer informatie geven. Meer slachtoffers uit EU en Nederland Het rapport stelt dat de precieze omvang van het fenomeen mensenhandel in Nederland onduidelijk is en nader dient te worden onderzocht. Het is echter wel is duidelijk dat er steeds meer verschillende soorten uitbuiting en slachtoffers zijn, terwijl de aanpak van mensenhandel nog vooral gericht is op slachtoffers van seksuele uitbuiting zonder geldige verblijfstitel. Ongeveer een kwart van de geregistreerde slachtoffers is de laatste jaren onderhevig aan arbeidsuitbuiting en de groep slachtoffers zonder verblijfstitel neemt af, vooral door de uitbreiding van de EU. Daarnaast is er een grote groep Nederlandse slachtoffers van uitbuiting. De hulpverlening zou beter afgestemd moeten worden op deze diversiteit, zodat er minder slachtoffers tussen wal en schip vallen. Volgens de Nederlandse slachtoffers wordt er te gemakkelijk vanuit gegaan dat zij terug kunnen vallen op mantelzorg en dat de reguliere opvangplekken toereikend zijn.

    Combating Trafficking in Human Beings for Labour Exploitation

    Combating trafficking in human beings (THB) for labour exploitation requires additional skills, knowledge and awareness for effective investigation and prosecution, and for the identification and assistance of victims of this form of THB. Actors other than the police and the prosecution services (such as labour inspectorates, social investigation services and municipalities) have also become involved in these activities. It is unclear which role these actors can have in identifying victims and in investigating and prosecuting (cross-border) THB for labour exploitation and which improvements are needed. They are often unfamiliar with, for instance, the specific needs of victims, how trafficking networks operate, and how to cooperate with colleagues abroad. These problems obviously hamper the combating of THB for labour exploitation. In addition, difficulties in defining THB for labour exploitation still exist. Labour exploitation, as such, is not a term used in the Palermo Protocol or the EU Directive on Preventing and Combating THB and Protecting Victims. One can say that labour exploitation includes at least, forced and compulsory labour and services, slavery and slavery-like practices, although this does not solve the problems encountered in defining the crime. In this book, these and other problems, as well as the challenges of dealing with these problems, are identified. It includes research in five countries (Austria, The Netherlands, Romania, Serbia and Spain), research on the EU legal framework, an analysis of the country studies as well as four articles reflecting on these problems. Conny Rijken is Associate Professor at Tilburg University and Senior Research Fellow at INTERVICT. Dr. Rijken has done extensive research on Trafficking in Human Beings especially from an EU point of view. Furthermore she is specialised in the field of European Criminal Law. Rijken was project coordinator of the EU funded project Combating THB for Labour Exploitation . Some of her other notable recent assignments include the establishment of Joint Investigation Teams, raising awareness in the Judiciary on Trafficking in Human Beings, and the certification of the prostitution sector in the Netherlands.

    Human trafficking in the Sinai started in 2009 and involves the abduction, extortion, sale, torture and killing of men, women and children. This book follows from the publication "Human Trafficking in the Sinai: Refugees between Life and Death" (2012). It describes how refugees are abducted and brought to the Sinai and identifies the modus operandi of the trafficking. It also looks at what happens after the hostages are released and where they go. This book introduces the term 'trafficking cycle' to describe how refugees become trapped in a vicious cycle of detention, exploitation and abuse, or take risks that may lead to tragedies such as the shipwreck off the coast of Lampedusa on 3 October 2013. It also portrays how Sinai survivors remain owners of their own history and keepers of their own dignity. The book is based on interviews with hostages and survivors of the trafficking in the Sinai and others. Mirjam van Reisen is Professor of International Social Responsibility at Tilburg University. Meron Estefanos is a Swedish journalist of Eritrean decent. Conny Rijken is lawyer and a specialist in trafficking in human beings at Tilburg University. Guest author, Erik Borgman, is Professor of Systematic Theology at Tilburg University.
