In het oude Romeinse recht was de homo sacer een mens die door iedereen straffeloos gedood mocht worden. Hij werd buiten het menselijke én het goddelijke recht geplaatst. De homo sacer markeert de grens tussen het burgerrechtelijke leven en het naakte, onbeschermde leven. Dit leven op de grens, in een niemandsland, biedt Agamben de sleutel tot een kritische analyse van de westerse politieke traditie, waarin het leven de inzet van de politiek is geworden en de politiek veranderd is in biopolitiek. Aan de hand van de relatie tussen het naakte leven en de soevereine macht – van Aristoteles via de Verklaring van de rechten van de mens en de burger tot Auschwitz – presenteert de auteur het concentratiekamp als het paradigma van de moderne tijd. Het kamp blijkt de ruimte te zijn waarin regel en uitzondering, leven en dood niet meer van elkaar te onderscheiden zijn. Met een nieuw voorwoord van Gert-Jan van der Heiden Giorgio Agamben (1942) is een hedendaagse Italiaanse filosoof. Il corpo della politica
Al centro della politica occidentale, almeno a partire da Hobbes, sta il corpo: il corpo in carne e ossa dei cittadini e quello artificiale del 'grande Leviatano', l''automa' o il 'Dio mortale', formato dai corpi dei cittadini riuniti insieme in un corpo politico. La scissione e, insieme, l'impossibile articolazione di questi due corpi è l'eredità che Hobbes ha trasmesso alla politica occidentale. Il libro di Agamben investiga una dopo l'altra le contraddizioni e le difficoltà in cui il pensiero politico dell'Occidente è rimasto impigliato nel tentativo di costituire un body politic unitario, dalla dottrina teologica dei due corpi del re fino alla teoria dellamultitudo in Dante e Spinoza e all'essere generico di Marx. E, alla fine, è nella figura dell'esule, in cui corpo naturale e corpo politico coincidono, che queste contraddizioni sembrano ricomporsi. L'esilio cessa così di apparire come una figura politica marginale, per affermarsi come un paradigma filosofico-politico fondamentale, forse il solo che, rompendo la fitta trama della tradizione politica ancora dominante, consentirebbe di pensare da capo la politica dell'Occidente. Le contraddizioni esplodono invece nell'Unione Europea, un organismo che, non essendo altro che un patto fra Stati, manca necessariamente di un corpo politico unitario. E finché l'Europa continuerà a fingere una costituzione e un popolo che non può avere, essa resterà in ogni senso un political corpse, un cadavere politico asservito di volta in volta a interessi estranei. Forse solo a uno sguardo che, in un'Europa al tramonto, cercherà di cogliere ciò che è rimasto vivo nella sua tradizione culturale, qualcosa come una realtà politica europea diventerà per la prima volta visibile. Stasis è il nome della guerra civile nella Grecia antica. Un concetto così inquietante o impresentabile per la filosofia politica posteriore da non essere fatto oggetto di una dottrina adeguata, neppure da parte dei teorici della rivoluzione. Eppure, sostiene Giorgio Agamben fornendo qui i primi elementi di una necessaria 'stasiologia', la guerra civile costituisce la fondamentale soglia di politicizzazione dell'Occidente, un dispositivo che nel corso della storia ha permesso alternativamente di depoliticizzare la cittadinanza e mobilitare l'impolitico, e che vediamo oggi precipitare nella figura del terrore su scala planetaria. Al suo paradigma concorrono insieme due poli antitetici dei quali Agamben mette allo scoperto la segreta solidarietà, quello classico secondo cui la guerra civile è coessenziale alla polis, al punto che chi non vi prende parte è privato dei diritti politici, e quello moderno rappresentato dal Leviathan di Hobbes, che ne decreta l'interdizione, ma introduce una scissione - e con questa la possibilità della guerra civile - all'interno stesso del concetto di popolo. Nel Novecento, è Carl Schmitt a rimettere in onore lo stato di natura così temuto da Hobbes, e a identificare proprio nella pericolosità dell'uomo naturale l'unico contenuto della condizione civile: politica e guerra si presupporrebbero a vicenda. Una visione tragica che esclude ogni altro criterio definitorio del politico, e si contrappone radicalmente a quella 'teologia del ludico' che, con Johan Huizinga, ascrive la guerra al dominio del gioco, nell'ipotesi che in origine la funzione agonale, ritualizzata o iniziatica, non mirasse all'annientamento degli avversari, ma fosse addirittura un mezzo per stringere relazioni; insomma, un 'gioco serio', poi sequestrato dallo Stato e piegato ad altri fini, mentre il nemico assumeva i tratti dell'inumano da passare per le armi.
