»Criminal Acts Against Sleeping or Unconscious Persons and Toddlers. A Comparison of the Offenses of Theft, Robbery, Deprivation of Liberty and Murder out of Malice«: The thesis provides a comparison of the various groups of persons and offenses using medical findings. This highlights various inconsistencies in the current state of research and develops possible solutions. Among other things, it is shown that sleeping and unconscious persons must be treated equally when it comes to a murder out of malice. Following on from this, a reform proposal for this characteristic of murder is presented.
Sandra Bachmayer studierte von 2014 bis 2020 Rechtswissenschaften an der Ludwig-Maximilians-Universität in München. Für ihre Leistungen in der Juristischen Universitätsprüfung wurde sie im Jahr 2018 vom Alumni- und Förderverein der Juristischen Fakultät der LMU München e.V. mit dem Sylvester-Jordan-Preis ausgezeichnet. Im Anschluss an die Erste Juristische Prüfung war sie von 2020 bis 2022 als wissenschaftliche Mitarbeiterin an der Professur für Strafrecht und Strafprozessrecht bei Prof. Dr. Matthias Krüger an der Ludwig-Maximilians-Universität in München tätig. Ab 2022 absolvierte sie das Rechtsreferendariat am Oberlandesgericht München.
